Case Brief: FDCPA and RFDCPA
On August 31, 2011, the collections abusive victim filed suit against NATIONWIDE CREDIT, INC., for violations of the FDCPA and RFDCPA. Ms. Prefontaine’s alleged debt owed had accrued from transactions for personal, family, and household purposes. In an attempt to collect this debt, the debt collector from NATIONWIDE CREDIT, INC engaged in conduct with the intent to harass, oppress, and abuse Ms. Prefontaine. Ms. Prefontaine claimed the debt collector violated the FDCPA and RFDCPA by:
(i) Calling her and leaving a voice message, asking Ms. Prefontaine to call the debt collector at a number belonging to him;
(ii) Calling Ms. Prefontaine on her home telephone and her mobile telephone numbers;
(iii) Failing to give meaningful disclosure of the debt collector’s identity; and
(iv) Failing to disclose in subsequent communications that the calls were from a debt collector.
