FDCPA Case Brief

On July 12, 2011, the collections abuse victim filed suit against PORTFOLIO RECOVERY ASSOCIATES, LLC, for violations of the FDCPA and RFDCPA. The collections abuse victim claimed that PORTFOLIO RECOVERY ASSOCIATES violated the FDCPA and RFDCPA, knowingly and willfully, by:

(i)                 Placing multiple calls daily, from different phone numbers;

(ii)               Refusing to disclose the caller’s name;

(iii)             Calling the victim a “liar” when the victim denied owing the alleged debt;

(iv)             Repeatedly demanding the victim’s bank account numbers;

(v)               Hanging up repeatedly and failing to leave messages;

(vi)             Refusing to cease and desist all telephone calls after the victim asked;

(vii)           Advising the victim that the collectors were allowed to call as much as they wanted;

(viii)         Failing to notify the victim of the right to dispute the alleged debt;

(ix)             Failing to provide the victim with proof of the alleged debt in writing; and

(x)               Engaging in rude and demeaning conduct, implying the victim was a criminal.
